ABOUT DODITTY

DoDitty provides unparalleled connections between world class artists and their fans.

DoDitty offers opportunities to enter sweepstakes (each a “Sweepstakes”). All Sweepstakes run by DoDitty are governed by these official rules (“Official Rules”). Some Sweepstakes may have additional information or requirements (“Additional Rules”). In that case, the Additional Rules will be posted on the page for that particular Sweepstakes.

The Sweepstakes are administered by DoDitty, LLC (“DoDitty”). DoDitty distributes donations made through the DoDitty online platform (“Platform”) to one or more charities (each a “Charity Partner”) in relation to each Sweepstakes as described herein. Each Sweepstakes is sponsored by an artist or musical act (each, a “Artist”) who offers one or more prizes (“Prizes”) in the hopes that you will make a donation with your entry to support the Charity Partner for that Sweepstakes. 

ENTERING A SWEEPSTAKES

No donation is necessary to enter a Sweepstakes. However, you will receive entries for making a donation. Many Sweepstakes also offer a reward (“Reward”) based on the amount of your donation. Reward are guaranteed. They are not a part of the Sweepstakes and are not awarded by random drawing.

HOW TO ENTER

By donating: Visit a Sweepstakes page at DoDitty.com and complete and submit by one of the donation entry forms to enter the Sweepstakes and support the Charity Partner.

Enter for free: Visit a Sweepstakes page at DoDitty.com, scroll to the bottom of the page, select “Enter Without Donation,” and complete and submit the free entry form.

In order to ensure that entries are treated equally regardless of the amount of a donation, if any, DoDitty uses the following system. An entry form accompanied by a donation receives up to the maximum number of entries per person per Sweepstakes as described on each Sweepstakes page. Each free entry form receives the number of entries of the average donation for that specific Sweepstakes.

Incomplete entries, late entries and entries submitted by means other than those specified on the Sweepstakes pages are void and will not be considered. DoDitty has the sole and exclusive discretion to determine whether an entry has been successfully submitted in compliance with these Official Rules. DoDitty and its Charity Partners shall have no liability for entries that are incomplete, lost, late, damaged, misdirected, stolen or otherwise not successfully submitted or for any electronic, hardware, software, network or internet malfunctions, failures or difficulties.

DoDitty shall disqualify any individual it finds to have tampered or be tampering with the entry process or the operation of the Sweepstakes including, without limitation, entering or attempting to enter the Sweepstakes multiple times by the use of any robotic or automated device, software or other strategy that in any way provides an unfair advantage over entries submitted manually as determined in DoDitty’s sole and exclusive discretion.

Each Sweepstakes is separate. Entry into one Sweepstakes is not entry into another Sweepstakes.

WHEN TO ENTER

Each Sweepstakes page will contain the start and end date (the “Entry Period”) for that particular Sweepstakes. Unless otherwise specified, the Entry Period starts at 12:00 A.M. Pacific Time (“PT”) on the start date and ends at 11:59 P.M. PT on the end date. All entries for a particular Sweepstakes must be completed and submitted online during the Entry Period.

WHO CAN ENTER

Each Sweepstakes is open only to legal residents of the 50 United States and District Columbia.

Each Sweepstakes is open only to individuals who are at least 13 years of age at the time of entry. Entrants under the age of 18 (or the majority in their jurisdiction of legal residence) must have the permission of their parent or legal guardian to enter, must have their parent or legal guardian sign any documents required for the winner confirmation process, and must be accompanied on any Prize experience by their parent or legal guardian.

Entries are limited to individuals only.

Employees, contractors, directors, and officers of DoDitty, the Artist for that particular Sweepstakes and the Charity Partner for that Particular Sweepstakes, each of their respective parent companies, affiliates, subsidiaries, distributors, dealers, sales representatives, web masters/suppliers, advertising and promotional agencies, anyone associated with the development, implementation or execution of a Sweepstakes, and members of the immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above (collectively, “Partners”) are not eligible.  However, anyone is permitted to make a donation without receiving an entry into a Sweepstakes.

In all cases, Sweepstakes are void where prohibited by law.

PRIZES

SELECTION AND NOTIFICATION OF WINNER

At DoDitty, we pride ourselves on offering fair and unbiased Sweepstakes that allow artists to connect with fans in meaningful ways.

Within 10 business days of the close of the Entry Period for each Sweepstakes, a potential winner(s) will be selected by a random drawing process from all eligible entries received during the Entry Period. The potential winner will be notified by telephone or e-mail using the contact information provided with the selected entry to begin the process to confirm that the potential winner meets the required legal standards.

The potential winner must cooperate fully with the confirmation process, which may include submitting an affidavit of eligibility and submitting to a criminal background check of the potential winner and their guest(s), if applicable. DoDitty may disqualify any potential winner or potential winner’s guest(s) if DoDitty determines, in its sole discretion, that said winner or guest(s) may pose a danger to, or harm the reputation of, any person or entity involved in the Sweepstakes.

Failure to fully cooperate with the confirmation process may result in disqualification at DoDitty’s sole discretion. Failure to respond to DoDitty’s communications, including, but not limited to, notification of the potential winner, notification of a positive outcome of the confirmation process, or requested return of any requested documents, within the time period designated in the communication will result in disqualification.

If a potential winner is disqualified for any reason, DoDitty will award the Prize to an alternate potential winner selected by a random drawing from among all remaining eligible entries.

All winners receiving a Prize with an approximate retail value of $600 or more will be issued an IRS Form 1099 by the Charity Partner as required by law. All winners receiving a Prize with an approximate retail value of $5,000 or more will be issued an IRS Form W-2G (Certain Gambling Winnings) by the Charity Partner which will withhold income tax as required by law.

PROMOTION OF WINNER

Unless otherwise prohibited by law, by accepting a Prize, you grant to DoDitty, the Charity Partner for the particular Sweepstakes and the Artist for the particular Sweepstakes the right to use your full name, city and state of residence, photograph, voice and/or other likenesses, testimonials, biographical information (in whole or in part) and information regarding the Prize you won for any and all purposes, including, but not limited to, advertising and promotional materials for DoDitty, in any form now known or later developed, throughout the world in perpetuity with no additional compensation.

WINNERS LIST

For the winner(s) of a Sweepstakes or for a copy of these Official Rules, send a self-addressed stamped envelope to  DoDitty, 1625 Broadway, Suite 800, Denver, CO 80202, no later than 30 days after the end of the Entry Period for a particular Sweepstakes.

RESTRICTIONS OR CONDITIONS ON PRIZES

Each Sweepstakes page will contain a description of the Prize for that particular Sweepstakes including the approximate retail value and any additional restrictions or conditions for that Prize.

Unless otherwise specified, all Prizes are non-transferable and no substitution by the Winner or cash equivalent is allowed. DoDitty reserves the right to substitute the Prize for one of equal or greater value.

Any meetings with celebrities are subject to security and background checks. If you or your guest(s) are, as determined in the sole discretion of DoDitty, Charity Partners or Artists, obnoxious, threatening, abusive or harassing at any point before or during the Prize or Prize-related travel, DoDitty, Charity Partners and Artists reserve the right to deny or terminate the travel or the Prize, in whole or in part, and to disqualify the winner and award the prize to an alternate potential winner selected by a random drawing from along all remaining eligible entries.

The following restrictions and conditions apply to all Prizes involving travel:

• The winner must travel on the dates and itinerary specified by DoDitty. Winner and guest(s) must travel on the same itinerary.
• All airfare is economy class and all hotel accommodations are standard class, unless otherwise specified.
• If the winner lives within a 200-mile radius of the site where the Prize is to be awarded, ground transportation or a stipend for ground transportation may be provided in lieu of air transportation.
• The winner is responsible for obtaining any necessary travel documents, including, but not limited, to photo identification, passports, visas or other required documentation.
• Additional travel restrictions, conditions and limitations may apply.
• Any and all expenses not specified in the Prize description, including, but not limited to, meals and gratuities, additional transportation, upgrades, checked baggage fees, and incidental hotel expenses, are the sole responsibility of the winner and the winner’s guest(s).
• DoDitty, Charity Partners and Artists are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission of any third party with respect to travel, and no refund or compensation will be made for any results thereof.
• Lost, damaged or stolen tickets, travel vouchers, certificates or similar items will not be replaced.
• The approximate retail value may vary depending on departure and destination cities, date of travel and fluctuations in travel costs and is stated on each Sweepstakes page. Any difference between the actual value and the approximate retail value advertised will not be awarded.
• Chances of winning depend on the number of entries and are stated on each Sweepstakes page.
• If the winner elects to travel or participate in the Prize without a guest, no additional compensation will be awarded.

PRIVACY POLICY

Except as otherwise set forth herein, all information collected from an entrant is subject to the DoDitty privacy policy available at https://doditty.com/privacy-policy/ (“Privacy Policy”). Please read the Privacy Policy for details about how information is collected and used by DoDitty, the Artists and the Charity Partners. By entering a Sweepstakes, you agree to the Privacy Policy.

ABOUT THE DONATION

HOW DONATIONS ARE PAID

In addition to the free method of entry, you may enter a Sweepstakes by making a donation. All donations are received and processed by DoDitty and/or its third-party service provider. DoDitty distributes all donations, less third-party service provider and payment processing fees, to the Charity Partner designated for a particular Sweepstakes within 5 business days after the end of the Entry Period, unless the Charity Partner fails to meet the requirements for an eligible charity set forth in the Charity Partners Agreement between DoDitty and each Charity Partner (the “Charity Eligibility”) at that time.

Within 10 business days of DoDitty’s payment to the Charity Partner, each Charity Partner remits payment to DoDitty for DoDitty’s direct cost and expenses associated with that particular Sweepstakes, including, but not limited to, advertising and Prize fulfilment, as well as a fee of up to 20% of the donations received for that particular Sweepstakes to cover the cost of maintaining the Platform.

While DoDitty takes all reasonable steps to distribute the donations to the Charity Partner designated for a particular Sweepstakes, including pre-qualifying the Charity Partner in advance of the Sweepstakes Entry Period, in the rare case that a Charity Partner may fail to meet the requirements for Charity Eligibility at the time of distribution, DoDitty reserves the right to reassign the funds to another organization of their choice.

TAX-DEDUCTIBILITY OF DONATIONS

All donations will be acknowledged by a donation receipt issued by the Charity Partner for the particular Sweepstakes. A donation to a Charity Partner made through the Platform may be tax-deductible to the extent allowed by law. No donation is required to enter a Sweepstakes, and a donation does not increase your chances of winning a Sweepstakes, therefore, the donation is fully tax-deductible for U.S. federal income tax purposes to the extent allowed by law. If you receive a Reward for your donation, the amount of your donation that is deductible for U.S. federal income tax purposes may be reduced by the value of goods or services received. Consult your donation receipt for the details about your donation. Contact your tax advisor with any questions regarding the tax-deductibility of your donation.

REFUNDS

All donations are non-refundable except in the event of a fraud. By making a donation on the Platform, you waive all rights to challenge the donations or request a refund or chargeback. No exchanges for Rewards will be accommodated.

ADDITIONAL TERMS AND CONDITIONS

By entering a Sweepstakes, you unconditionally accept and agree to be bound by these Official Rules, by the Additional Rules, by all applicable laws, and by all decisions of DoDitty, which shall be binding and final. You waive any right to claim ambiguity with respect to these Official Rules and/or any Additional Rules.

DoDitty, the Charity Partners and the Artists are not responsible and bear no liability for any claim arising in connection with participation in the Sweepstakes or any Prize awarded. By participating in the Sweepstakes, you release DoDitty, the Charity Partners and the Artists, including the respective officers, directors, agents, contractors and employees of DoDitty, the Charity Partners and the Artists, from and against any and all liability, expenses, claims, injury, loss or damage caused or claimed that may arise in connection with your participation in the Sweepstakes or acceptance, awarding, receipt, use or misuse of the Prize, and you agree that DoDitty and the Partners are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion or the awarding of any Prize.

If DoDitty determines, in its sole discretion, that technical difficulties, malfunction, error, disruption or damage or other unforeseen events compromise the administration, security, fairness, integrity, proper conduct or viability of a Sweepstakes, DoDitty reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the Prize from all eligible entries received as of the termination date. DoDitty reserves the right to suspend, modify or cancel any Sweepstakes or any individual drawing(s) before the scheduled end date of the Entry Period. In the event a Sweepstakes is cancelled, all entries into such Sweepstakes will be deemed null and void, all donations will be refunded to the donors thereof, no winners will be selected and no rewards will be delivered.

These Official Rules, Additional Rules, and the Sweepstakes are governed and controlled by the laws of the State of Tennessee. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of Tennessee. By participating in the Sweepstakes, you consent to the jurisdiction of the state courts of Tennessee and the federal courts located therein with respect to any action, dispute or other matter pertaining to or arising out of the Sweepstakes.
